Arbitration Procedures

Important Note: These arbitration procedures do not apply to users who agreed to the Terms of Use dated February 28, 2022 or later and did not opt out of retroactive changes in the Dispute Resolution section. For those users, disputes follow the rules in the Terms of Use they agreed to.

1. What is Arbitration?

Arbitration is an alternative to court. A neutral arbitrator hears both sides and decides. It is faster, simpler, and less formal than court proceedings.

2. Try to Resolve Disputes First

3. Arbitration Administrator

Arbitration is handled by JAMS, a neutral third party. The arbitrator is chosen from their roster. Learn more at https://www.jamsadr.com/. Rules & fees are here: Streamlined Arbitration Rules.

4. Rules That Apply

Arbitration follows JAMS’s rules, modified by these procedures. The arbitrator can adjust rules if strict enforcement is unfair.

5. How to Start Arbitration

You may represent yourself or have a lawyer. Sugaryy may assert counterclaims.

7. Discovery

Both sides may request non-privileged documents and claim details. Requests must be made within 21 days of arbitrator appointment and responded to within 15 days. Arbitrator resolves disputes about discovery.

8. Communications

Include both parties when communicating with the arbitrator. Ex parte communications are not allowed. Conferences usually occur via phone or email.

9. Confidentiality

Information disclosed during arbitration cannot be used outside arbitration except to enforce the award. Confidential filings may be submitted under seal.

10. Arbitration Hearing

By default, arbitration is based on written submissions. You may request an oral hearing within 10 days of the arbitrator’s assignment.
